  • If an ICE agent arrives on campus seeking access or information:

  • Eastern follows protocols established by the CSCU Office of General Counsel and Connecticut State law:

    • ICE agents will be directed to the President’s Office or Chief of Police.
    • Eastern complies with the Connecticut Trust Act, which limits cooperation with ICE enforcement actions.
  • No. Eastern Police Officers and security personnel will not arrest or detain individuals based solely on administrative warrants issued by ICE or other federal agencies. This is in compliance with the Connecticut Trust Act.

  • The Connecticut Trust Act prohibits state and local law enforcement from arresting or detaining individuals based on immigration detainers or administrative warrants issued by federal immigration agencies. This ensures that individuals on campus are treated in accordance with state law and that their legal rights are respected.

    Connecticut Law Enforcement and the Trust Act

    Prohibited Actions:

    Connecticut law enforcement officers are prohibited from:

    • Arresting or detaining individuals based on immigration detainers or administrative warrants.
    • Performing any function of federal immigration enforcement.
    Exceptions:

    Connecticut law enforcement may cooperate with ICE only under the following circumstances:

    1. The person has been convicted of a Class A or B felony.
    2. The person is identified as a possible match in the Federal Terrorist Screening Database or a similar database.
    3. The person is subject to a federal court order due to failure to comply with an immigration officer’s subpoena or refusal to testify before an immigration officer.

    By clarifying these prohibitions and exceptions, we aim to ensure that our community understands both the limitations on Connecticut law enforcement and the specific situations in which cooperation with ICE is required.

  • Under the Family Educational Rights and Privacy Act (FERPA), all students are entitled to privacy regardless of immigration status. Educational records cannot be disclosed without a judicial warrant, subpoena, court order, or student consent. Eastern will uphold FERPA and deny requests for student information unless legally required to comply.

  • The Connecticut State Colleges and Universities System (CSCU) does not use the term "sanctuary campus," as it lacks legal definition and authority.

    Additionally, Eastern is no longer designated as a "sensitive location" under ICE policy. The previous guidance from 2011 was rescinded on January 21, 2025.
